These Terms of Use ('ToU') govern access to and use of the ErQuickS platform, published by ErQuickS, a company incorporated under Cameroonian law. By accessing the platform, you unconditionally accept these ToU in their entirety.
These ToU are established in accordance with Cameroonian law, notably: Law No. 2010/021 of 21 December 2010 governing electronic commerce in Cameroon; Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime; CEMAC Regulation No. 02/18/CEMAC/UMAC/CM of 21 December 2018 on payment systems, means and incidents in the CEMAC zone; and applicable OHADA Uniform Acts on commercial companies.
1. Definitions
- Platform: All ErQuickS services accessible via the mobile application (iOS and Android) and the website erquicks.com.
- Publisher: ErQuickS, a limited liability company incorporated under Cameroonian law, with its registered office in Yaoundé, Cameroon.
- User: Any adult natural person (18 years or older) holding an account on the Platform.
- Customer: User who places orders through the Platform.
- Merchant: Professional or legal entity registered as a seller on the Platform after KYC verification. The Merchant acts as an independent seller and bears sole responsibility for their products.
- Driver: Independent service provider registered on the Platform to carry out deliveries as a self-employed worker. The Driver is not an employee of the Publisher.
- KYC: Identity verification procedure (Know Your Customer) required for Merchants and Drivers, in accordance with applicable due diligence obligations.
- NotchPay: Payment partner approved by the BEAC for processing Mobile Money payments (MTN MoMo and Orange Money) in the CEMAC zone.
- XAF: Central African CFA franc — the legal currency of Cameroon, issued and controlled by the Bank of Central African States (BEAC).
2. Purpose and nature of service
The ErQuickS Platform is an on-demand delivery marketplace connecting Customers wishing to order products, Merchants offering goods or services, and Drivers handling order transport. The Publisher acts exclusively as a technical intermediary and is not a party to any commercial transaction between Merchants and Customers.
In accordance with Law No. 2010/021 on electronic commerce in Cameroon, the Publisher is a provider of information society services. As such, it is not responsible for content posted by Merchants, provided it acts promptly to remove any illegal content brought to its attention.
3. Registration and account
3.1 Account creation
Registration is open to any adult natural person residing in Cameroon. It is carried out by entering an active Cameroonian phone number (MTN or Orange network) followed by OTP (One-Time Password) verification sent primarily via WhatsApp through a self-hosted service or SMS as fallback (Techsoft). No password is required for Customers; security relies on possession of the phone number and OTP verification.
3.2 Authentication methods
Several authentication methods are available according to User preferences:
- OTP WhatsApp / SMS: Default mode. 6-digit code, valid for 10 minutes, maximum 3 attempts. Primary channel: WhatsApp; fallback channel: SMS.
- Social login: Social login (Google, Apple and Facebook) is temporarily frozen for v1 and may be reintroduced in v2 after validation procedures are completed.
- Biometric authentication: Face ID or fingerprint available as a quick unlock method after initial login. Biometric data remains strictly on the User's device (via expo-secure-store) and is never transmitted to ErQuickS or any third party.
- Security PIN: An optional security PIN can be configured to enhance account access protection and facilitate recovery.
- Backup email: Merchants and Drivers may register a backup email address for account recovery.
3.3 Registration obligations
- Provide accurate, complete and up-to-date information.
- Not impersonate another person or pose as a fictitious entity.
- Only one account per natural person is permitted. Creating multiple accounts constitutes a breach of these ToU.
- The User is solely responsible for the confidentiality of their access and actions carried out from their account.
3.4 KYC Verification (Merchants and Drivers)
In accordance with applicable due diligence obligations in the CEMAC zone and BEAC requirements for anti-money laundering, Merchants and Drivers must mandatorily submit: (i) a valid national identity document (Cameroonian National Identity Card or passport); (ii) a liveness video selfie; (iii) for Merchants, the business registration document (business licence, trade register or equivalent). Merchant or Driver account activation is subject to approval of these documents by the ErQuickS team within 2 to 5 business days.
4. Services offered
4.1 For Customers
- Access to the catalogue of merchants and products available in the delivery zone.
- Order placement with secure escrow payment (MTN/Orange Mobile Money).
- Real-time GPS delivery tracking on an interactive map.
- Delivery confirmation via QR code or OTP code generated by the app.
- In-app messaging with the Driver during active delivery (text and media).
- Dispute management and integrated customer support via WhatsApp or in-app interface.
- Cashback programme: receive a percentage of your purchases as cashback during promotional campaigns. Cashback can be used as a partial payment method for future orders. It is non-convertible to cash and subject to campaign-specific expiry dates.
- Loyalty points: accumulate points with each completed order. Points can be redeemed for benefits available in the Rewards tab. They have an expiry period configured by the Publisher and expire automatically. Unused points are permanently forfeited upon account deletion.
- Referral programme: refer new Users using your unique referral code displayed in the app. A reward is granted only when the referred user completes at least one first order on the Platform.
- Gift orders: option to send an order to a third party (recipient name, phone number, personalised message).
- Coupons and promotional codes: percentage or fixed-amount discounts, with a minimum order amount and expiry date.
4.2 For Merchants
- Creation and management of a product catalogue organised in sub-categories (maximum 3 sub-categories and 50 active products per sub-category).
- Real-time receipt and management of incoming orders.
- Access to an analytics dashboard (revenue, order volume, trends).
- Earnings paid by Mobile Money transfer (MTN or Orange) after each confirmed delivery.
- All submitted product images are subject to automatic content moderation analysis (NSFW system). Any sexually explicit, violent or immoral content is automatically rejected. The Merchant is responsible for the compliance of submitted images.
4.3 For Drivers
- Receipt and acceptance of geolocated delivery offers in real time.
- Integrated navigation (optimised route) to the merchant and customer.
- Transparent per-mission earnings tracking in the in-app history.
- In-app messaging with the Customer during an active mission (text and media).
- Electronic signature of the independent service provider contract directly in the app before the first mission. This signature is timestamped and legally binding. The Driver operates as a self-employed worker and not as an employee of the Publisher.
- Earnings paid via Mobile Money after confirmation of each delivery.
5. Payments, pricing and escrow
5.1 Accepted payment methods
Payments on the Platform are exclusively made in XAF (CFA Francs) via the following methods: (i) MTN Mobile Money or Orange Money — processed by NotchPay, BEAC/COBAC approved partner; (ii) Visa or Mastercard bank card — the User is redirected to the secure payment page hosted by NotchPay to enter their card details; ErQuickS does not collect or store any card number, CVV or expiry date — only a NotchPay transaction reference is retained; (iii) promotional cashback balance — usable as partial payment, non-convertible to cash. No cash payments are accepted via the Platform.
5.2 Escrow mechanism
When placing an order, 50% of the total amount (products + dynamically calculated delivery fees based on distance) is immediately debited from the Customer's chosen payment method and placed in escrow. The remaining balance (50%) is charged at the time of delivery confirmation. Funds are only remitted to the Merchant after effective delivery validation by the Customer (QR code scan or entry of delivery OTP), net of the ErQuickS commission. If the delivery is not confirmed by the Customer within the configurable grace period set by the Publisher, the delivery is automatically validated and funds released (auto-validation).
5.3 Card payment — confirmation timeout
In case of card payment, payment confirmation is checked by the app for a maximum of 120 seconds after redirection to NotchPay. If confirmation is not received within this period (browser closed, connection interrupted, timeout), the order is created but remains in payment pending status. The User can check the order status in their history. If a debit occurred without in-app confirmation, the User is invited to contact support at support@erquicks.com with the order reference; the payment will be verified and the order confirmed or refunded within 24 business hours.
5.4 Payment link (third-party payment)
The Platform offers a payment link feature (short code) allowing a third party to pay for an order on behalf of the Customer. When a third party uses this link to make a payment, their payment data (Mobile Money number or bank card details) is transmitted directly to NotchPay, subject to NotchPay's terms and conditions applicable to the third-party payer. ErQuickS is not responsible for the third-party payer's obligations or the data they communicate to NotchPay. The Customer remains the sole order holder and responsible for its execution.
5.5 ErQuickS commission
For Merchants, commission is calculated on the product subtotal of each completed order and deducted from the payout. Standard rates are: Food 20%, Grocery and supermarket 10%, Fashion 18%, Home and decor 14%, Electronics and high-tech 10%, Beauty and cosmetics 12%, Stationery and supplies 6%. If no applicable category is found, the technical fallback is the rounded average of this grid, or 12.86%. The exact rate is shown before registration and remains available in the account.
A personalisation applies to one Merchant and a fixed period. It states the standard reference rate, proposed rate, dates and justification. It applies only after the Merchant's explicit acceptance. Any adverse increase may only be decided by a Super Administrator with at least 30 days' notice and no retroactive effect. On expiry, the then-published standard rate applies again.
For Mizio Partners, the platform retains 12% of delivery remuneration. Estimated mission earnings are shown before acceptance and amounts remain available in the Mizio account.
5.6 Delivery fees
Delivery fees are calculated dynamically based on the distance between the Merchant and the Customer's delivery address, with a guaranteed minimum rate. They are clearly displayed to the Customer before final order confirmation. No hidden fees are applied.
5.7 Cancellation and refunds
An order may be cancelled by the Customer free of charge only before a Driver accepts it. After acceptance, any cancellation is subject to the support team's assessment. In case of a dispute validated in favour of the Customer, the refund is made to the Customer's Mobile Money account within 48 business hours.
6. User obligations
6.1 Common obligations
- Not use the Platform for unlawful, fraudulent or purposes contrary to these ToU and Cameroonian legislation.
- Not attempt to circumvent, hack or alter the Platform's security systems (offence punishable under Law No. 2010/012 on cybercrime).
- Not publish false, misleading, offensive or third-party rights-infringing content.
- Immediately report any unauthorised use of their account to support@erquicks.com.
6.2 Merchant-specific obligations
- Maintain an up-to-date catalogue (prices, availability, photos consistent with actual products).
- Prepare orders within announced timeframes and comply with food hygiene and safety standards in accordance with Cameroonian regulations.
- Not offer illegal, counterfeit, prohibited or products requiring unobtained authorisations.
- Hold the administrative authorisations required for their commercial activity (business licence, health authorisation where applicable).
6.3 Driver-specific obligations
- Keep GPS location active throughout accepted missions.
- Deliver orders on time, in good condition and with due respect to Customers and Merchants.
- Hold a valid driving licence and insurance for the vehicle used, in accordance with Cameroonian legislation.
- Never demand or accept cash payments outside the Platform system.
7. Liability
In accordance with Law No. 2010/021 on electronic commerce in Cameroon, the Publisher, as a technical intermediary, cannot be held liable for direct or indirect damages resulting from: non-performance or poor performance of orders by Merchants or Drivers; temporary service interruptions for technical maintenance or force majeure events; failures of telecommunications networks (MTN, Orange) or Mobile Money payment systems.
Merchants are solely responsible for the compliance of their products and activities with Cameroonian legislation (quality, hygiene, authorisations). Drivers are solely responsible for their conduct during deliveries and the compliance of their vehicle and documents with legal requirements. The Publisher cannot be held liable for damages caused by Drivers during their missions.
8. Intellectual property
The ErQuickS Platform, its logo, visuals, source code and all its constituent elements are the exclusive property of ErQuickS and are protected by Cameroonian intellectual property laws as well as international conventions to which Cameroon is a party. Any reproduction, representation, modification or exploitation without prior written authorisation is strictly prohibited and constitutes an infringement subject to legal proceedings.
By publishing content on the Platform (product photos, descriptions), Merchants grant the Publisher a non-exclusive, worldwide, royalty-free licence to use this content for the purposes of operating and promoting the Platform.
9. Personal data protection
The collection and processing of Users' personal data are governed by our Privacy Policy, established in accordance with Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime in Cameroon and international data protection principles. By accepting these ToU, the User consents to the processing of their data as described in the Privacy Policy.
10. Account suspension and termination
10.1 Termination by User
The User may request account deletion from the app (Profile → Settings → Delete my account), subject to eligibility: no pending orders, no open disputes. See the Data Deletion page for the detailed procedure.
10.2 Termination by Publisher
The Publisher reserves the right to temporarily suspend or permanently terminate any account in case of: breach of these ToU; proven fraudulent conduct; repeated and verified reports; criminal conviction of the User for acts committed via the Platform. The concerned User will be notified by SMS or in-app notification at least 48 hours before suspension, except in characterised emergencies (ongoing fraud, security threat).
11. Disputes between users
In case of a dispute related to an order, the Customer or Merchant may open a dispute file directly from the app within 24 hours of the incident. The ErQuickS team undertakes to process the file within 5 business days. The parties undertake in good faith to attempt amicable resolution before any legal action. If amicable mediation fails, the parties may refer the matter to the competent courts in accordance with Article 12 below.
12. Applicable law and competent jurisdiction
These ToU are governed by Cameroonian law, in particular Law No. 2010/021 governing electronic commerce and applicable OHADA Uniform Acts. Any dispute relating to the interpretation, performance or termination of these ToU, which could not be resolved amicably, falls under the exclusive jurisdiction of the courts of Yaoundé, Cameroon, without prejudice to the Publisher's right to apply to any other competent court for interim measures.
13. ToU modifications
The Publisher reserves the right to modify these ToU at any time to reflect legal, regulatory or functional developments of the Platform. Users will be informed via in-app notification and/or SMS at least 15 days before substantial modifications take effect. Continued use of the Platform after this period constitutes acceptance of the new terms. If refused, the User may request account closure.
14. Miscellaneous provisions
- Entire agreement: These ToU constitute the entire agreement between the User and the Publisher regarding use of the Platform.
- Severability: If a clause is declared void, the other clauses remain in force.
- Non-waiver: Failure to sanction a breach does not constitute a waiver of the right to sanction a subsequent breach.
